5. Ordering, Pricing, and Payment Terms
5.1 Order Placement and Confirmation
When you place an order through our Site, you are making an offer to purchase the items selected at the displayed price. All orders are subject to availability and acceptance by Pizza Luce. We will send you an order confirmation via email or on-screen notification; however, this confirmation does not constitute our final acceptance of your order. We reserve the right to refuse or cancel any order at any time prior to delivery or pickup.
5.2 Pricing
All prices displayed on our Site are in United States Dollars (USD) and are inclusive of applicable menu pricing but may be subject to applicable sales taxes, delivery fees, service charges, and other surcharges, which will be disclosed to you prior to finalizing your order. Pizza Luce reserves the right to change menu prices at any time without prior notice. In the event of a pricing error on our Site, we reserve the right to cancel any orders placed at the incorrect price and notify you accordingly.
5.3 Payment Methods
We accept various forms of payment as indicated on our Site, which may include major credit cards, debit cards, and other electronic payment methods. By submitting a payment, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the full order amount, including applicable taxes and fees, to that payment method.
5.4 Refunds and Cancellations
Refund and cancellation requests are handled on a case-by-case basis. Given the perishable nature of food products, refunds or replacements are generally issued only where the food received is materially different from what was ordered, is of unacceptable quality, or was not delivered. To request a refund or report an issue with your order, please contact us at [email protected] within 24 hours of receiving your order. Pizza Luce's determination regarding refunds and replacements shall be final.
5.5 Taxes
You are responsible for the payment of all applicable sales taxes, use taxes, and other government-imposed charges associated with your purchase, which will be calculated and added to your order total at checkout in accordance with applicable United States federal and state tax laws.
6. Delivery Terms
Delivery is available within designated service areas only. Estimated delivery times are provided as a courtesy and are not guaranteed. Factors including, but not limited to, traffic conditions, weather, high order volume, and distance may affect delivery times. Pizza Luce shall not be liable for delays in delivery caused by circumstances beyond our reasonable control.
You are responsible for providing an accurate and accessible delivery address. If a delivery cannot be completed due to an incorrect address, inaccessible location, or failure of the customer to be present to receive the order, Pizza Luce shall not be obligated to issue a refund for that order.
7. Intellectual Property Rights
All content on our Site, including but not limited to text, graphics, photographs, logos, icons, audio clips, digital downloads, data compilations, software, and the compilation of all content (collectively, "Content"), is the exclusive property of Pizza Luce or its content suppliers and is protected by United States copyright, trademark, trade dress, and other applicable intellectual property laws.
The Pizza Luce name, logo, and all related product and service names, design marks, and slogans are trademarks or service marks of Pizza Luce. You may not use any of these marks without our prior written permission. All other trademarks, product names, and company names or logos mentioned on our Site are the property of their respective owners.
7.1 Limited License
Pizza Luce grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Site and its Content solely for your personal, non-commercial use in connection with placing orders and using our services. This license does not include:
- Any resale or commercial use of the Site or its Content;
- Any collection and use of product listings, descriptions, or prices;
- Any derivative use of the Site or its Content;
- Any downloading or copying of account information for the benefit of another merchant or business;
- Any use of data mining, robots, or similar data gathering and extraction tools.
Any unauthorized use of our Content or Site terminates the permission or license granted by Pizza Luce.
7.2 User-Submitted Content
If you submit reviews, comments, feedback, photographs, or other content to our Site or social media channels associated with Pizza Luce ("User Content"), you grant Pizza Luce a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all rights to the User Content you submit and that the use of such content does not violate these Terms or any applicable law.
8. Disclaimers and "As-Is" Basis
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PIZZA LUCE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;

Customers with food allergies or dietary restrictions are strongly advised to contact us directly before placing an order. While we take reasonable precautions, we cannot guarantee that our products are free from allergens including nuts, gluten, dairy, eggs, shellfish, or other common allergens, as our kitchen handles a wide variety of ingredients.
No advice or information, whether oral or written, obtained by you from Pizza Luce or through our Site shall create any warranty not expressly stated in these Terms.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL PIZZA LUCE, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:
- Your use of, or inability to use, our Site or services;
- Any unauthorized access to or alteration of your transmissions or data;
- Any food products ordered through our Site, including any health issues arising from consumption;
- Any third-party conduct or content on our Site;

IN NO EVENT SHALL PIZZA LUCE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU IN FULL. IN SUCH CASES, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE STATE LAW.
10. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce and its affiliates, subsidiaries, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

Pizza Luce reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of such claim. You may not settle any claim subject to this indemnification provision without our prior written consent.
11. Privacy Policy
Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Site and services, you consent to our collection, use, and sharing of your personal information as described in our Privacy Policy. Our privacy practices comply with applicable United States federal privacy laws, including the Federal Trade Commission Act (FTC Act), and applicable state privacy laws, including, where applicable, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) for California residents.
12. Third-Party Links and Services
Our Site may contain links to third-party websites, platforms, or services that are not owned or controlled by Pizza Luce. These links are provided for your convenience only. Pizza Luce has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We do not warrant or make any representations regarding the accuracy, completeness, legality, or any other aspect of any third-party content.
We strongly advise you to read the terms of service and privacy policies of any third-party websites you visit. Your use of third-party platforms, including payment processors and delivery partners, is subject to their respective terms and conditions.
13. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to these Terms or your use of our Site and services shall be governed by and construed in accordance with the laws of the United States and the applicable state laws of the jurisdiction in which Pizza Luce is registered and operates, without regard to conflict of law principles that would require the application of the laws of another jurisdiction.
To the extent that any dispute is not subject to the arbitration clause set forth in Section 14 below, you agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in the applicable United States jurisdiction where Pizza Luce operates, and you waive any objection to such jurisdiction or venue.
Pizza Luce's services are intended for use within the United States. We make no representations that our Site or services are appropriate or available for use outside the United States. If you access our Site from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
14. Dispute Resolution
14.1 Informal Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services ("Dispute"), we encourage you to first contact us informally at [email protected] to attempt to resolve the matter. We will make a good faith effort to resolve any Dispute informally within thirty (30) days of receiving written notice from you describing the nature of the Dispute and the relief you are seeking.
14.2 Binding Arbitration
If we are unable to resolve a Dispute informally within thirty (30) days, both parties agree that the Dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect, except as modified by this Agreement. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.
You agree that any arbitration shall be conducted on an individual basis and not as a class action, class arbitration, or representative action. You expressly waive the right to bring or join a class action lawsuit or class-wide arbitration.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights.
14.3 Exceptions to Arbitration
Claims that qualify for small claims court proceedings in the applicable jurisdiction may be brought in such court instead of arbitration, provided the dispute remains in that court and is not moved to another forum.
15. Food Safety and Allergen Notice
Pizza Luce operates in compliance with applicable United States federal food safety laws and regulations, including the Food Safety Modernization Act (FSMA) and regulations administered by the U.S. Food and Drug Administration (FDA), as well as applicable state and local food safety codes and health department requirements.
Our food products are prepared in a kitchen environment that handles common allergens including, but not limited to, wheat/gluten, dairy, eggs, nuts (including tree nuts and peanuts), soy, fish, shellfish, and sesame. We cannot guarantee that any menu item is completely free from cross-contamination with allergens. Customers with known food allergies or dietary restrictions should exercise caution and contact us directly at [email protected] before ordering to inquire about specific ingredients.
Consuming raw or undercooked foods may increase the risk of foodborne illness. Consumer advisories apply. By ordering our food products, you acknowledge and accept these risks.

17. Changes to These Terms
Pizza Luce reserves the right to revise, amend, or update these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or by posting a prominent notice on our Site.
Your continued use of our Site or services after the effective date of any changes to these Terms constitutes your binding acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed about your rights and obligations.
18. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or contrary to public policy for any reason, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if modification is not possible, such provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any particular provision shall not affect the validity, legality, or enforceability of any other provision of these Terms, and the remaining provisions shall continue in full force and effect as if such invalid, illegal, or unenforceable provision had never been included.
19. Waiver
No failure or delay by Pizza Luce in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that right or remedy or the exercise of any other right or remedy. Any waiver by Pizza Luce must be in writing and signed by an authorized representative to be effective.
20. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by Pizza Luce on the Site, constitute the entire agreement between you and Pizza Luce with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
No oral or written information or advice given by Pizza Luce, its employees, officers, or agents shall create any warranty or in any way increase the scope of Pizza Luce's obligations under these Terms.
21. Force Majeure
Pizza Luce shall not be liable for any delay or failure in performance of its obligations under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, government actions or restrictions, labor disputes, supply chain disruptions, utility failures, cyberattacks, or any other event outside our reasonable control ("Force Majeure Event"). In the event of a Force Majeure Event, our obligations under these Terms shall be suspended for the duration of the Force Majeure Event, and we will make reasonable efforts to notify you of the situation and resume performance as soon as practicable.
